Acceptable use policy

This acceptable use policy sets out what Apogee Coach (“Apogee”) may and may not be used for. It forms part of the terms of service between MoonBoots Consultancy UK Ltd (“MoonBoots”, “we” or “us”) and the business that uses Apogee (“you” or “your”). It applies to you and your team members and, through you, to your clients.

1. Use Apogee lawfully

1.1 You must not use Apogee in any way that breaks the law, infringes anyone’s rights, or helps someone else to do so.

2. Content

2.1 You must not upload, send or publish anything through Apogee that:

• is unlawful, defamatory, threatening, abusive, harassing, hateful or discriminatory;
• is sexually explicit, or sexualises anyone;
• shows or concerns a child inappropriately;
• infringes copyright, trade marks or other rights, for example music, videos or images you do not have permission to use;
• is misleading, including claims that your services can cure, treat or prevent illness, or promises of guaranteed results;
• promotes or supplies prescription-only medicines, including weight-loss injections, or illegal or banned substances;
• contains viruses or other harmful code.

2.2 The app does not allow under-18s to upload progress or body photos, and you must not try to get around this.

3. Health and safety

3.1 You must not use Apogee to diagnose or treat medical conditions unless you are qualified and insured to do so, and then only within the rules of your profession.

3.2 Review your clients’ health screening (PAR-Q) answers before training them, and act on what they tell you.

3.3 Do not pressure clients into unsafe training, diets or weight loss.

4. Messages and marketing

4.1 Send marketing emails or texts only to people who have agreed to receive them, and respect every unsubscribe. The app records consent and adds an unsubscribe link and your postal details to campaign emails. You must not get around these.

4.2 Never send marketing to anyone under 18.

4.3 Do not send spam, chain messages or unsolicited bulk messages, or use Apogee to send messages for other businesses.

4.4 Use group texts only for messages about your own business, to your own clients and contacts.

5. Personal data

5.1 Collect only the personal data you need, use it only for the purposes you have told people about, and keep it accurate.

5.2 Do not record health information beyond what you need to coach a client safely.

5.3 Do not put other people’s personal data into Apogee without a lawful reason.

6. Security and fair use

6.1 You must not:

• try to access accounts, data or systems you are not authorised to use, including another coach’s data;
• probe, scan or test the security of Apogee without our written permission. If you find a vulnerability, please tell us at hello@apogee.coach;
• interfere with or overload Apogee, or try to get around its limits, such as the daily limits on AI and messaging;
• scrape or extract data with automated tools, other than the export tools we provide;
• copy, resell, sublicense or rebrand Apogee for anyone else, other than as your own business’s app;
• share a login between people. Each coach login is for one person.

6.2 Fair use limits apply. Each coach account includes 120 minutes of stored exercise video, and AI features have daily limits per person and per coach. We may change these limits with notice.

7. Your clients

7.1 You are responsible for how your clients use your app. If you become aware of misuse, take reasonable steps to stop it, and tell us if it affects Apogee or other users.

8. If this policy is broken

8.1 We may remove content, restrict features, or suspend or close accounts, as the terms of service allow, and may report unlawful activity to the authorities. Where it is reasonable to do so, we will tell you first.

9. Reporting misuse

9.1 Please report any misuse of Apogee to hello@apogee.coach.
